This move follows the permanent implementation of a $20,000 visa bond program for non-immigrant visa applicants from 50 countries, including Nigeria. That program was designed to reduce visa overstays by ensuring applicants can cover their costs during their stay. Now, the new bond system extends this approach to certain immigrant visa holders, particularly those who were initially rejected based on public charge criteria. Under the new rules, consular officers have discretion to set bond amounts on a case-by-case basis, considering each applicant's unique situation. Some cases being processed currently involve bonds ranging from $100,000 to $250,000. The State Department explained that this measure is based on longstanding legal authority under the Immigration and Nationality Act (INA). It allows the department to require certain visa applicants, who are deemed likely to become public charges, to post a bond as proof of their ability to self-support. The bonds are intended to protect public benefit programs from financial strain caused by immigrants arriving with significant medical expenses or other substantial needs. Officials argued that such measures help maintain the integrity of social safety nets and ensure that immigration contributes positively to society. The Department of State noted that the Dominican Republic was chosen for the pilot due to the high volume of immigrant visa applications processed at the U.S. embassy in Santo Domingo. Beginning Tuesday, eligible applicants who were previously denied visas on public charge grounds will be offered the chance to submit a bond as proof of financial capability. This provides an alternative pathway for those who might otherwise be excluded from the immigration process. U.S. Citizenship and Immigration Services will oversee the cancellation of bonds after five years, provided the immigrant does not receive public cash assistance or long-term government-funded institutional care during that time. If the bond conditions are violated, the agency will decide whether to cancel it or impose further consequences.
