OGH poništava djelomičnu oslobađanje za Benko

The Austrian Supreme Court (OGH) has upheld the conviction of Rene Benko, founder of Signa, for fraudulent financial practices, but overturned part of his acquittal regarding a second charge involving a €360,000 advance payment for a villa in Innsbruck. Benko was initially sentenced to two years in prison in October 2025 for allegedly giving €300,000 to his mother, thereby concealing assets from creditors. The OGH ruled that this gift constituted a fraudulent transfer, dismissing the defense’s claim that subsequent funds from his mother negated the harm. Regarding the second charge, the court found the advance payment lacked value for creditors and was not a valid transaction.
