Željko Kerum, former mayor of Split and leader of the Croatian Civic Party (HGS), has stepped down from his position as head of the party following his release from custody. The leadership of the HGS has been taken over by Igor Stanišić, who previously served as president of the City Council of Split. This move comes after Kerum was released from prison following an investigation into alleged illegal construction and encouraging a former city official to legalize previously unauthorized buildings on private property. The investigation, initiated by the Office for the Suppression of Organized Crime and Corruption (USKOK), focuses on three individuals, Kerum, Andrija Polić, and Kerum's nephew Igor Sapunar, for suspected abuse of office and incitement to abuse of office. According to police and USKOK reports, Polić, while serving as a senior technical assistant for spatial planning and construction in the City of Kaštela, allegedly illegally facilitated Kerum and his company in the process of legalizing buildings constructed after June 2011. Kerum was the client and project manager for construction work on land registered under his company, which he owned in real terms. From March 2020, he became the legal representative of the company. Sapunar, Kerum’s nephew, was authorized to represent the company in Kerum’s real ownership. Investigators suspect that Kerum and Sapunar requested Polić to issue a decision legalizing buildings and other structures constructed after June 2011, despite knowing there were no legal conditions for issuing such a decision. Some of these buildings were not visible on the digital orthophoto map of the State Geodetic Administration from 2011. Others did not match the size and area shown in the geodetic and architectural documentation submitted with the request. Despite this, Polić prepared a statement in August 2022 claiming he had determined through reviewing the 2011 orthophoto map that unauthorized buildings existed on the parcel. However, instead of attaching the 2011 map, he used one from 2017, on which the buildings were already visible. He then compiled a record stating that the size, degree of completion, and purpose of the buildings and structures matched the state observed during an inspection conducted in September 2022. On January 26, 2023, he issued a decision legalizing five buildings, including three commercial properties, two residential buildings, a pool, and a workshop, totaling a gross floor area of 1,965.65 square meters. USKOK suspects that Polić thereby unlawfully enabled Kerum and his company to construct buildings significantly larger than those existing before June 21, 2011, and to build new, legalized buildings in agricultural zones outside the urban area of the General Urban Plan of Kaštela, where such construction was not permitted. Kerum was arrested following a series of investigative articles published by Telegram journalist Denis Mahmutović. His downfall marked the end of our investigative series on his real estate misdeeds, excluding a previous incident involving a minor traffic accident. In the following sections, we present the Telegram texts that triggered the USKOK investigation. At the beginning of May, we published a story about Pršut, Kerum’s newly opened restaurant in Kaštela. We revealed that the Pršut complex, including a pool, workshop, chapel, and other floors, was built illegally. The Building Inspection had long identified the illegal construction and ordered its removal, but the restaurant was never demolished. Kerum continued expanding on land classified as "particularly valuable arable land," ignoring the inspection. How was this possible? Thanks to a Copernican turn by Kaštela municipal officials who issued a legalization decision, even though the documentation did not match the actual situation on the ground, which can be seen literally from an airplane. Illegal construction and the exploitation of maritime assets Andrija Polić, who composed the disputed document, was at the time pretending to run for the position of chief executive officer in the City of Split, where Kerum held power. Since then, he has not been mentioned in that context. Polić, then a senior technical assistant for spatial planning in Kaštela, legally declared that the buildings visible on official state maps were nonexistent, allowing Kerum to formally convert illegal buildings into legal ones through forged documents. In short, his signature on an official document allowed illegal buildings to become officially legal. The next text focused on Perl, Kerum’s luxurious hotel resort in Rogoznica, near the sea. The complex consists of a hotel, apartments, villas, deluxe rooms, a pool, a restaurant, and related facilities. We revealed how Kerum illegally built a villa and hotel complex spanning maritime assets and then, with the passivity of the State Attorney’s Office, mortgaged the maritime asset for multimillion loans from a bank. He exploited the maritime asset as a private ATM. Such a maneuver was possible because the Republic of Croatia, represented by the State Attorney’s Office, has failed to register the asset on public records for 13 years, which the Kerum family has successfully exploited for years. ‘Telegram ordered an investigation’ We later revealed how Kerum had erected an illegal marina for yachts on maritime assets in Rogoznica, directly opposite the Perl resort, which has been advertised for years as "marina" and "ideal destination for sailors with all necessary amenities." Despite a ruling by the Supreme Administrative Court declaring the concession process illegal, Kerum operated the marina under the nose of the competent authorities. Eventually, after our article, the Ministry of Maritime Affairs, Transport, and Infrastructure banned the use of the illegal docking facility, which must now be removed from the maritime asset. Kerum followed our revelations with nervous, paranoid posts on social media, called emergency meetings where he claimed he would seek asylum, and in telephone conversations, he ranted and insulted the signed journalist. In his final appearance on freedom, he seriously stated that Telegram had ordered an investigation against him, mentioning DORH, USKOK, the State Inspectorate, and Carina. Kerum was arrested last night in Velika Luka while relaxing at a concert commemorating Oliver Dragojević.
