Judge Russell Coleman presided over the case and emphasized that challenging government policy decisions typically falls outside the scope of judicial intervention unless there is a clear issue of illegality. He stated that if he had overturned the policy, it would likely lead to the same decision being made again by officials. This sentiment underscored the court’s reluctance to interfere with administrative discretion in matters of public policy. Under the existing framework, students who arrive in Hong Kong as minors and hold dependant visas or entry permits are classified as local residents. They are eligible for government-funded programs and pay approximately HK$47,000 per year in tuition fees. In contrast, non-local students face much higher costs, with annual fees reaching around HK$141,000. Some non-local families have opted to send their children to study on the mainland, where they can sit for the Diploma of Secondary Education (DSE) exams required for university admission. The ruling reflects the judiciary’s deference to executive authority in shaping immigration and education policies.
