A Honduran court has cleared former President Juan Orlando Hernández of money laundering and fraud charges, effectively freeing him from legal constraints in his home country. The dismissal of the case came after a judicial review that found insufficient evidence to link him to the alleged crimes, marking a pivotal moment in his legal journey following his controversial return to Honduras last year. Hernández, who served as president from 2014 to 2020, returned to Honduras in July 2023 after spending nearly four years in a U.S. federal prison. His extradition to the United States had followed a conviction for drug trafficking, for which he received a 45-year sentence. However, he was released in December 2023 after receiving a presidential pardon from former U.S. President Donald Trump. Upon returning to Honduras, Hernández vowed to face justice in his homeland, though some legal experts expressed doubts about the strength of the local judiciary to handle such a high-profile case. The charges against Hernández were part of a broader corruption investigation known as Pandora I. According to the Specialized Prosecutor's Office Against Corruption Networks (UFERCO), the probe looked into the misuse of public funds between 2010 and 2013, involving a network of former high-ranking officials. The investigation claimed that over $10.8 million in public funds were improperly allocated to various foundations during that period. Hernández allegedly benefited from these disbursements, reportedly receiving at least $2.3 million for his political campaigns through methods such as the creation of shell companies, the use of intermediaries, and fictitious contracts. Despite these allegations, Hernández consistently denied wrongdoing. During the court proceeding, he stated that the charges lacked merit and did not provide sufficient grounds to hold him accountable. The court ruled that the evidence presented failed to establish his direct involvement in the events under scrutiny. This decision was announced via the official social media account of the Honduran Judiciary, stating that the evidence did not confirm the defendant's participation in the investigated activities. The public prosecutor’s office had sought to have the evidence admitted and for a formal indictment to be issued against Hernández. However, the judge rejected this request, leading to the former president’s definitive release. Previously, he had been granted conditional release as the legal process unfolded. Following the court’s decision, a large group of Hernández’s supporters gathered outside the courthouse, mirroring their presence during earlier stages of his legal proceedings. Addressing the crowd, Hernández declared that this chapter of political persecution was coming to an end, both in the United States and in Honduras. Carlos Silva, a spokesperson for the Supreme Court, noted that any party involved in the proceedings who disagrees with the court’s decision could still file an appeal. This leaves open the possibility of further legal action, although the immediate outcome appears to favor Hernández.
