Macklem emphasized that the bank believed its actions fell under exceptions in the Labor Code that permit the use of replacement workers in cases where there is a threat to life, health, or safety, or potential serious damage to property. The security officers at the Bank of Canada began striking in June after negotiations over a new collective agreement broke down. The Public Service Alliance of Canada, which represents the workers, has called on the bank to cease using replacement workers and return to the bargaining table. The union noted that 42 members at the Ottawa office and seven at the Montreal office have been on strike for four weeks following the bank's lockout in Montreal. A spokesperson for the Bank of Canada, Paul Badertscher, confirmed in an email that the bank has stopped using replacement workers and the services of bargaining unit members since complying with the CIRB's rulings. This aligns with Macklem's assertion that the bank followed the board's directives promptly. Legislation passed in 2024 prohibits federally regulated workplaces from hiring replacement workers during legal strikes, and the new rules became effective last year. Bea Bruske, president of the Canadian Labour Congress, criticized the Bank of Canada in a letter to Macklem, Jobs Minister Patty Hajdu, and Secretary of State for Labour John Zerucelli, stating that the bank's repeated non-compliance with the CIRB's orders was unacceptable. She highlighted that the law was designed to protect collective bargaining and uphold workers' constitutional right to strike. Macklem, whose term as governor will end in one year, reiterated the bank's commitment to pursuing a fair settlement through the negotiation process.
