For attacking a 70-year-old farmer from Kleč two years in prison

Napad na 70-letnega kmeta iz Kleča, ki je zadevno zasegao dva brata – Aleksandra in Primoža Strojana, je v nedeljo, 16. septembra, končno vodil do sodne obsade. Okrožno sodišče v Ljubljani je obsojila obeh obtoženih na po dve leti zapora. Decembrska sodna preseda je bila rezultat dolgega pravnega postopka, ki je vključeval raziskave, dokumentacijo in spremembe v obtožbah. Tretji napadalec, Stanka Železnik, je po kmetu padale še brce v zadnjico in hrbet. Kmet je utrpel zlom dna leve očesne votline in leve ličnice, poškodovala sta mu tudi čeljust. Kljub hudim poškodbam je Čemažar uspel sam odpeljati domov, kjer je bil potolčen, okrvavljen in zaslepljen.

Sodnica je v svojem obrazložitvi sodbe poudarila, da je napad storjen brez povoda, čeprav je bil kmet v nekaterih primerih znotraj svoje lastnine. "Napadla sta ga brez povoda, pa tudi če bi obstajal, za takšno nasilje ni opravičila," je dejala. Odvetnica Lea Krstić, ki je zastopala Aleksandra Strojana, je poudarila, da se je Aleksander sam predal policistom in priznal, da je kmeta večkrat udaril v obraz. Dveletna kazen, ki jo je predlagala tožilka Ana Kirm, je bila za Aleksandra Strojana previsoka, zato je podvomila o oceni psihiatričnega izvedenca Petra Preglja, da je bil obtoženi v času kaznivega dejanja nebistveno zmanjšano prišteven. Aleksander Strojan je namreč trdil, da je bil pod vplivom heroina, sanvala in alkohola.

Sodnica je v svojem obrazložitvi sodbe poudarila, da je bilo dejanje storjeno iz gole objestnosti in da ni bilo nobenih olajševalnih okoliščin. Obtožena sta bila s sodbo nezadovoljna, zato je pričakovati pritožbo. Oškodovanec, Anton Čemažar, je obsojenima segel v roke in ju pozval k pameti. Sodnica je preklicala pogojno obsodbo Aleksandra Strojana, s katero je bil zaradi tatvine obsojen na štiri mesece zapora. V končno kazen pa je vštela tudi v preteklosti izrečeno kazen zaradi kaznivega dejanja poškodovanja tuje stvari. Aleksander Strojan bo v zaporu dve leti in pet mesecev. Sodnica je podaljšala pripor zaradi ponovitvene nevarnosti.

V nadaljevanju bo treba spremljati pritožbo obtoženih, kjer bodo mogli predložiti novi argumenti ali dokaze. Tudi tožilstvo bo moralo predstaviti svoje stališče glede pritožbe, kar lahko vključuje predlog za spremembo kaze. Vendar pa je sodnica že določila, da je bilo dejanje zelo težko in da ni bilo nobenih olajševalnih okoliščin. Zato je verjetno, da bo sodnica odradila pritožbo. Vseeno bo treba spremljati razvoj primera, ker je zadeva zelo pomembna za družinske in pravne vztike v regiji.
