Smart devices such as speakers, televisions, vacuum cleaners, or wearables increasingly rely on cloud services and regular updates to function properly. If these digital foundations disappear, essential device functions can vanish, and expensive hardware may lose much of its value or become electronic waste. Consumers are not entirely defenseless against this scenario, thanks to recent legislative changes that establish clear rules regarding the provision and maintenance of digital services. The legal framework has evolved to distinguish between traditional goods and those with digital elements, devices dependent on software, apps, or cloud services. These distinctions are outlined in sections 475a through 475e of the German Civil Code (BGB). According to these provisions, there is a general obligation to maintain digital content indefinitely unless otherwise agreed upon in the contract. This means that digital services must remain functional for at least two years after delivery of the device and must include updates that ensure the device's security. In practice, manufacturers and retailers often extend support periods beyond this minimum due to the extended time many devices remain available in the market. For example, if a manufacturer produces a product over several years and sells it, they must continue providing digital services for two additional years after the last sale. As a result, customers who purchase such devices early in their lifecycle benefit from longer support periods. However, this does not automatically guarantee that all connected products retain their cloud-based features throughout their entire technical lifespan. Consumers should carefully review terms and conditions for any clauses that might limit the duration of service availability. Retailers may agree to shorter service periods, particularly in cases of bargain purchases or restocking items. Therefore, buyers should consider how long a product has been on the market, how long the provider promises updates, and whether the device can still be useful without cloud connectivity. Additional regulations apply to specific categories of devices. The European Union’s Eco-design Directive mandates that smartphone and tablet manufacturers provide updates for at least five years after ceasing production. Smart TVs must receive updates for eight years. These durations must be clearly indicated on the EU energy label, allowing consumers to reference them in case of disputes. If a manufacturer fails to uphold its commitments, consumers can invoke the contractual obligation to maintain digital services, even if the manufacturer becomes insolvent. Legally, the retailer remains the contracting party, not the manufacturer. Should the retailer fail to deliver the promised service because the manufacturer has discontinued support and no alternative exists, the BGB recognizes this as impossibility of performance under Section 275. In such circumstances, consumers have rights to seek remedies, though the exact process may vary depending on local laws and individual contracts. Consumers affected by the discontinuation of digital services are advised to contact the retailer first, as they are typically the contractual partner responsible for warranty claims. However, reaching out to the manufacturer can also be beneficial, especially to clarify whether a service is permanently discontinued or temporarily unavailable. This proactive approach ensures that consumers understand their options and can take appropriate steps to protect their investment.
