A Slovenian woman has been sentenced to five years in prison for killing her former partner after he attacked her with a knife. The case concluded today at the Maribor District Court, where Judge Maja Balajić handed down the verdict against Fahrije Rama, a Kosovo-born Slovenian national. Rama was brought from the prison in Igou in the final stages of the trial. The incident took place on July 22 last year, between 8 and 10 pm, in Lovrenc na Pohorju. According to the court records, Rama had moved into the home of Richard Žvikart, whom she had previously known as a friend. She had sought his help after ending a previous relationship marked by domestic abuse. Žvikart offered support, including free accommodation, and they communicated through letters before she arrived at his residence. However, Žvikart did not accept her desire for friendship and attempted to force intimacy upon her. In a fit of rage and fear that she might leave him, he attacked her with a kitchen knife, cutting her arm. In response, Rama seized the knife and inflicted severe injuries to his chest, neck, and abdomen. He died from blood loss while still at the scene. Rama called her sister and told her she had saved the victim, then handed the knife to her and left through a window. The police were later informed, but the body remained unattended until authorities arrived. Initially charged with murder, which could have led to a sentence of five to 15 years in prison, the prosecution later changed its stance. Prosecutor Tinka Berk revised the charge to manslaughter, which carries a lighter penalty, ranging from one to ten years in prison. Key factors influencing this change included a psychiatric evaluation conducted by Dr. Kristijan Jejcic and a trauma assessment by Dr. Dragica Maja Smrke. Jejcic found that Rama was suffering from a significantly reduced capacity for action due to post-traumatic stress syndrome, triggered by past experiences of abuse. Smrke noted that the injuries on Rama’s arm were likely caused by another person, making self-inflicted harm unlikely. Prosecutor Berk recommended a six-year sentence, citing the lack of evidence of coercion despite Žvikart being the initial aggressor. She argued that Rama used the knife in self-defense, but continued the attack even after Žvikart had disarmed himself. The court considered the violent nature of the assault, the failure to seek medical assistance, and the absence of emergency calls as aggravating factors. However, mitigating circumstances included Rama's diminished mental state and prior lack of criminal record. Her defense attorney, Sabina Žurga, advocated for leniency, arguing that the act constituted excessive self-defense. She emphasized that Rama needed professional support rather than incarceration. She suggested that the sentence should be lower than the prosecutor's recommendation. Judge Balajić, however, followed the prosecutor’s lead. In her ruling, she acknowledged Rama’s lack of prior convictions, her reduced capacity for action, and the presence of a child. Yet, she deemed the conduct during the attack as persistent and unjustified. The judge stated that Rama did not provide immediate aid to the deceased nor call for help, leading to the decision for a five-year prison term. Rama will remain in custody pending further legal proceedings. Her case highlights the complex interplay between self-defense, mental health, and the legal system’s approach to domestic violence. It also underscores the challenges faced by individuals who have endured prolonged abuse and how such trauma can influence their actions in moments of crisis.
