The Committee welcomes new nicotine rules

The Austrian Health Insurance Fund (ÖGK) has welcomed new regulations introduced under the Tobacco and Smoke-Free Environment Protection Act (TNRSG), which came into effect yesterday. The updated rules include provisions for nicotine-containing products such as nicotine pouches, nicotine sticks, and nicotine snuff, as well as non-nicotine items that mimic tobacco or nicotine products, such as certain caffeine- and CBD-infused pouches. These items are now subject to legal oversight under the revised legislation. Under the new measures, individuals who discard tobacco or similar products on playgrounds face substantial fines. Additionally, the ban on the sale of disposable e-cigarettes will take effect at the start of 2027. The ÖGK emphasized that these changes are particularly crucial for protecting children and adolescents, noting that appealing flavors, modern product designs, and the perception of many new nicotine products as harmless alternatives could lower the threshold for initiation. The updated regulations aim to address growing concerns over the accessibility and appeal of nicotine products among younger populations. The inclusion of a wide range of nicotine-based and mimicking products reflects broader efforts to regulate emerging nicotine delivery systems more effectively. The law also introduces stricter controls on how these products are marketed and sold, with specific restrictions on their availability in retail settings.
