The defense has filed a criminal complaint in connection with the bankruptcy of the 4th Army
The Czech Ministry of Defense has filed a criminal report against 4 Army S.R.O., alleging fraud, harm to creditors, and possible favoring of certain creditors. The report relates to the insolvency proceedings of the company, which had three contracts with the ministry between 2023 and 2025, including the supply of containers and field equipment, and the provision of new field kitchens for the Czech army at a cost of 65 million crowns. During the insolvency process, the company transferred claims to another firm despite the contract explicitly prohibiting such action. In response, the ministry transferred funds into court escrow. Ministerstvo obrany podalo trestní oznámení proti neznámému pachateli za podezření ze spáchání trestných činů, jako jsou podvod, poškození věřitele a možné zvýhodnění věřitele. Toto oznámení souvisí s insolvenčním řízením firmy 4 Army, která dodávala kontejnerové systémy a polní kuchyně pro českou armádu. Insolvenční řízení bylo zahájeno v říjnu loňského roku, což vedlo ke zásadní změně v rozdělování finančních prostředků spojených s třemi smlouvami uzavřenými mezi ministerstvem a firmou v letech 2023–2025. Smlouvy zahrnovaly dodávky kontejnerové techniky, polní kuchyní, včetně projektu Kalich, který byl hodnoty 65 milionů korun.

V reakci na tento krok ministerstvo vložilo peníze do soudní úschovy, aby soud rozhodl o jejich vyplacení. Podle zjištění resortu měly tyto finance být rozděleny mezi všechny věřitele, včetně ministerstva, podle zákona. Naopak, místo toho měly být peníze vyplaceny jedinému věřiteli, což bylo v rozporu s insolvenčním zákonem. Do řízení bylo přihlášeno 13 věřitelů s pohledávkami přesahujícími 450 milionů korun.
Ministerstvo obrany zdůraznilo, že důsledně chrání veřejné prostředky a usiluje o to, aby finanční prostředky byly využity k uspokojení všech věřitelů podle zákonných pravidel. Vysvětlilo, že trestní oznámení bylo podáno v reakci na podezření, že k takovému postupu nemuselo dojít všude. V rámci sporu s firmou 4 Army bylo také uplatněno smluvní sankce za pozdní dodávku polní kuchyně Kalich, která měla být dodána do října 2024. Ministerstvo uplatnilo sankci ve výši 35 milionů korun.
Firma 4 Army vede s ministerstvem i spor kvůli dodávce speciálních mobilních kontejnerů pro chlazení potravin, osobní hygienu nebo pitnou vodu. Ministerstvo požaduje také smluvní pokutu ve výši 580 000 korun za pozdní dodání kontejnerových mrazniček. Společnost získala tato zakázky, ale nedodala produkty v stanoveném termínu, což vedlo k finančním následkům.
Trestní oznámení bylo podáno na neznámého pachatele, což naznačuje, že ministerstvo neposkytuje konkrétní informace o identitě osoby nebo organizace, která by mohla být zodpovědná za zneužití finančních prostředků. Vrchní státní zastupitelství v Praze bude rozhodovat o dalších krocích, včetně možného vyšetřování.
