Alleged police violence in Cologne: Prosecutors investigate the case of Pedro C.

The German state prosecutor’s office in Cologne has initiated criminal investigations into two police officers and a paramedic following a police operation in which 30-year-old Pedro C. suffered irreversible brain damage and fell into a coma. The incident occurred on April 8th, and the investigation was launched after initial assessments failed to find evidence of excessive force, prompting further scrutiny. Pedro C., a Venezuelan national with mental health issues, was placed in an exceptional situation following the death of a close family member. His friends called a paramedic, who arrived intending to transport him to a hospital. When C. refused to leave his home, the paramedic contacted the police. After approximately 90 minutes, C. had to be resuscitated. During this time, he remained inside his apartment while police and medical personnel waited outside. Initially, the Cologne State Prosecutor's Office stated there were no indications of excessive force by law enforcement. This assessment was based primarily on body camera footage captured by the officers involved. However, experts have expressed concern over the handling of the case. Some noted that C. appeared to be overly monitored, including being fitted with protective masks meant to prevent the spread of infectious diseases, and administered strong sedatives. These actions raised questions about whether they were proportionate given C.’s condition. C.’s lawyer, Simón Barrera González, criticized the police response, alleging racial bias and stigmatization due to C.’s HIV diagnosis, despite his low risk of transmission. He argued that the treatment C. received was unjustified and potentially violent. In July, after weeks of pressure, Barrera gained access to the body camera recordings. According to him, these videos revealed not only physical violence but also verbal abuse directed at C. He claimed that even before the video emerged, the circumstances should have warranted an initial suspicion of misconduct. Further evidence came from a video C. recorded himself just before the police and paramedics entered his residence. The footage shows C. appearing nervous but not aggressive, nor posing a threat to others. Upon opening the door, he was immediately tackled by a police officer to the ground. This video became a key piece of evidence leading to the current investigation. The prosecutor’s office cited the video as grounds for initiating proceedings against one police officer and one police officer. It states that the actions depicted in the video raise questions about the proportionality of the measures taken. Additionally, an investigation is underway regarding the sedatives administered to C. by the paramedic. For Barrera González, the decision marks a partial victory, though he emphasizes that it is merely the beginning of a long legal process. He believes the authorities should have acted sooner, particularly given the available evidence.
