The International Criminal Court faces a challenging search for a new prosecutor

The International Criminal Court (ICC) is preparing for a challenging search for its new prosecutor following the resignation of Karim Khan. Several states have recently begun formal procedures to withdraw from the court, citing concerns over U.S. efforts to undermine its standing. Chad became the fifth country to initiate this process within the past months, joining Venezuela, Burkina Faso, Mali, and Niger. The ICC has launched a vote for a new prosecutor, though elections could take place as late as early next year due to the lengthy nature of the selection process. After Khan’s departure from his position, the court issued a statement reaffirming its commitment to fulfilling its mandate. “The ICC remains firmly committed to promoting accountability and ensuring justice for victims of crimes that deeply shake humanity,” the statement read. While member states evaluate the process for selecting Khan’s successor, the current deputy prosecutors, Nazhat Shameem Khan from Fiji and Mame Mandiaye Niang from Senegal, will lead the prosecution until a replacement is appointed. In the coming months, the governing body must determine the exact procedure for conducting the election. Experts suggest these upcoming elections will serve as a critical test of the court’s maturity, particularly given previous allegations of political pressure and procedural changes during past votes. Ezequiel Jimenez Martinez, author of a book on international court management, told Reuters that the assembly must demonstrate sufficient resolve to support the court during its most difficult moments and elect a prosecutor who is worthy of the role and its significance. Specialists believe that with the intensified U.S. diplomatic campaign against the ICC, finding a suitable replacement for Khan will prove especially challenging. “Who would even want to run for such a position if they know they will be sanctioned by the United States?” asked Melanie O’Brien, a professor of international law, for Reuters. The United States aims for the ICC to withdraw investigations targeting Israeli leaders, including Prime Minister Benjamin Netanyahu, over alleged war crimes in Gaza. It also wants the court to stop investigating potential crimes involving U.S. units. Some well-informed American officials told Reuters that the administration might be exerting pressure on certain countries to withdraw from the court. Chad announced its withdrawal on Monday, while Venezuela initiated its official exit process on Friday evening after the ICC investigated allegations of crimes against humanity during the previous government's rule. Both nations accused the court of bias in its decisions. The European Union and several key allies of the court, among them the Netherlands and Japan, which is one of its largest financial contributors, have expressed support for the court’s operations and concern over the U.S. stance regarding its functioning. However, they have not announced any specific measures aimed at protecting or strengthening the institution. As the situation unfolds, the ICC faces mounting challenges both internally and externally, requiring careful navigation to maintain its credibility and effectiveness.
