Justice forced Trump to return almost $ 100 billion collected for tariffs declared illegal

The U.S. Justice Department has ordered former President Donald Trump’s administration to refund nearly $100 billion in tariffs deemed illegal by the Supreme Court. These refunds apply to importers who paid these tariffs under a policy implemented via the International Emergency Economic Powers Act, which Trump used after returning to power in 2025. The Supreme Court ruled in February that Trump had exceeded his authority under this law by imposing tariffs on various trade partners. While the court’s decision limited the scope of Trump’s tariff policy, certain sector-specific tariffs, such as those on steel, aluminum, copper, and construction wood, remain in effect. As of July 31, approximately $128.68 billion in refund requests had been accepted, with around $100 billion already sent to the Treasury for disbursement.
