The prosecution sends four complaints for the attic bought by the Ayuso Government to the court that is already investigating the case

The Spanish Public Prosecutor’s Office has sent four formal complaints to a Madrid court regarding the purchase of a luxury apartment by the regional government led by Isabel Díaz Ayuso. The complaints were filed in recent weeks and relate to the acquisition of the property in Madrid’s Chamberí district for 6.3 million euros. This information was revealed through a decree issued this Monday, which was obtained by elDiario.es. According to the document, the assistant prosecutor, José Luis García-Juanes, ordered the closure of preliminary investigations initiated by the public prosecutor's office, citing that these matters are already under judicial scrutiny. The case originated after the extraparliamentary group Iustitia Europa filed a complaint with Madrid’s Judicial Courts last Thursday, requesting an investigation into the purchase of the property intended for meetings and later sold for 6.69 million euros. The transaction was conducted through the public company Planifica Madrid. The case has been assigned to Madrid’s Instruction Court Number 8, which has opened preliminary proceedings but has yet to rule on whether the complaint will be accepted, according to sources consulted. The decision by the Public Prosecutor’s Office to close the preliminary investigations is based on Article 5 of the Organic Statute of the Public Prosecutor and Circular 2/2022 from the General Prosecutor’s Office. These regulations establish that the Public Prosecutor’s Office must immediately cease its investigative actions upon learning of an ongoing judicial inquiry to prevent duplication. As such, all documents and communications from the complainants will be forwarded to the aforementioned court. In addition to the complaint from Iustitia Europa, three individuals and the Spanish Socialist Workers' Party (PSOE) have submitted denuncias to the Public Prosecutor’s Office. The PSOE accused the board of directors of Planifica Madrid of possible crimes of abuse of authority and misappropriation following the controversy over the apartment. Earlier reports from elDiario.es indicated that prior to the purchase, the seller was required to sign a confidentiality agreement. Iustitia Europa’s complaint requested a thorough investigation into whether the operation could constitute embezzlement of public funds, administrative misconduct, or misuse of public assets. The group demanded access to the complete procurement file, including assessments of necessity, valuation, urban legality, financing, and internal decisions made by Planifica Madrid. They also sought documentation related to the involvement of the Presidency Council and details concerning renovations at the Royal Post Office, real estate commissions, tax costs, and the subsequent decision to sell the property. The case highlights the growing scrutiny surrounding the use of public resources by regional governments, particularly in light of high-profile acquisitions that raise questions about transparency and accountability. While the judicial process continues, the move by the Public Prosecutor’s Office underscores the complexity of overlapping legal procedures and the challenges faced by investigators in ensuring compliance with procedural guidelines.
