Local elections in Lower Saxony: Suspended county councillor remains in limbo

The suspended mayor of Göttingen, Marcel Riethig, remains in limbo following disciplinary proceedings initiated by the Lower Saxony Interior Ministry. Despite potential re-election, he will likely be unable to take office due to ongoing legal processes extending into the municipal election on September 13. The case has drawn significant attention within local government circles, with allegations spanning multiple areas of misconduct. Riethig, who resigned from the Social Democratic Party (SPD) earlier this year, is running as an independent candidate in the upcoming election. His legal troubles began in February when 16 senior officials from Göttingen’s administrative department, including three deputy heads, submitted a formal complaint to the state's oversight body. This document, referred to locally as a “brandbrief” or public letter, listed 28 serious accusations against him. These included allegations of nepotism, abuse of power, compelling staff to act illegally, and fostering a climate of fear within the administration. Among the claims were specific instances such as appointing a close friend to a strategically important position within the administration and making decisions that allegedly favored individuals connected to him. There were also accusations regarding his handling of a temporary bridge project for cyclists, which reportedly bypassed procurement regulations and violated building and planning laws. The complaints detailed systematic pressure and intimidation tactics aimed at employees, leading to resignations and mental health issues among staff members. Dozens of other workers, many in leadership roles, joined the protest against their boss. In response, Riethig denied all allegations in detail, often through written statements and interviews. He argued that his actions were intended to expedite bureaucratic procedures and simplify approval processes for citizens. He acknowledged being a demanding and “uncomfortable” leader but maintained that his decisions were always in the public interest. In turn, the senior officials accused him of defamation and malicious slander, with both sides represented by legal counsel. On March 17, the Interior Ministry in Hanover temporarily suspended Riethig from duty and launched a disciplinary investigation concerning 12 of the 28 allegations. The suspension was described as a procedural safeguard rather than a punitive measure. The ministry emphasized that the process would continue beyond the election date. Meanwhile, prosecutors are still investigating the case under suspicion of fraud. In early August, State Interior Minister Daniela Behrens (SPD) stated that the complexity of the case would require more time than initially anticipated. It was unlikely that a resolution would be reached before the municipal election. Further documents and evidence were still being requested, indicating that the legal battle is far from over. As the election approaches, the outcome remains uncertain, with Riethig's fate hanging in the balance.
