Stepmother jailed for 12 years over manslaughter of girl, 5, in scalding bath

In a long-awaited trial that spanned decades, Janice Nix, 67, was sentenced to 12 years in prison for the 1978 death of her five-year-old stepdaughter, Andrea Bernard. The case, which came to light more than four decades after the incident, marked a significant moment in British legal history due to its delayed resolution and the emotional weight carried by the surviving family members. Nix was found guilty of both manslaughter and cruelty toward Andrea’s older brother, Desmond Bernard, during the period between 1975 and 1978.

The tragic event occurred on 6 June 1978, when Nix allegedly forced Andrea into a scalding bath after the child disobeyed her instructions. According to testimony given in court, Andrea sustained severe burns over half her body and died in hospital on 13 July 1978, five weeks after the incident. At the time, authorities treated the death as an accident. However, the truth remained hidden until 2022, when Desmond Bernard, now 56, came forward to the police with information about his sister’s death.

During the trial at Isleworth Crown Court, jurors heard detailed accounts of the day of the incident. Bernard described hearing his stepmother shout for Andrea to get into the bath and how Andrea pleaded that the water was too hot. He recounted hearing her screams and then Nix crying out for Andrea to “wake up.” When Bernard entered the bathroom, he found his sister limp and wrapped in a towel, with Nix cradling her. Nix reportedly asked him to lie about the circumstances of the incident, claiming it was an accident and that they had been in the garden at the time.

Desmond Bernard delivered a powerful victim impact statement in court, addressing Nix directly. He expressed the profound loss of his sister and the lasting trauma caused by the deception surrounding her death. He recalled the fabricated grief displayed at Andrea’s funeral and the manipulation of his family’s trust. “Your contrived grief at Andrea's funeral, the lies, the tears,” he told Nix. “You fooled my family because they couldn’t imagine the unimaginable.”

Judge Justice Lavender presided over the sentencing and emphasized the severity of Nix’s actions. He noted that Nix must have known the water was dangerously hot and that the risks associated with such an act should have been apparent. “I’m sure that you ran the bath, you knew how hot it was… You heard her screams,” the judge stated. He concluded that Nix’s behavior constituted a deliberate disregard for Andrea’s safety and well-being.

Nix was also found guilty of cruelty toward Desmond Bernard during the years 1975 to 1978, when he was between seven and nine years old. This additional charge highlighted the broader pattern of abuse within the household, which extended beyond Andrea’s death.

As part of her sentence, Nix will serve two-thirds of the 12-year term before being eligible for release on licence. The court acknowledged the gravity of the crime but also considered the passage of time since the incident. Despite this, the sentence reflects the seriousness of the charges and the harm inflicted upon both Andrea and Desmond.

The case has drawn attention not only for its historical significance but also for the resilience of Desmond Bernard in coming forward after so many years.
