The case emerged from the Brucknerhaus affair, which saw Luger resign as mayor of Linz in the summer of 2024. At the heart of the charges was a dispute over the management of the Brucknerhaus, a cultural venue in the city. In 2017, the leadership of the venue was put up for tender, with Luger, then mayor and chairman of the LIVA board, favoring Dietmar Kerschbaum, a close personal friend. Before the selection process, Luger reportedly passed on questions to Kerschbaum, who ultimately won the position. In 2023, a whistleblower alert surfaced among the LIVA board, prompting Luger to commission a €19,000 expert report. He did not disclose that he himself was the source of the leak. By 2024, the issue became public, leading to his resignation. The prosecutor alleged that Luger had abused his authority, causing financial harm to the LIVA through this act. During the trial, key testimony came from a lawyer who had advised Luger as chair of the LIVA board. This attorney testified that Luger had revealed himself as a whistleblower to him. However, the lawyer stated that this disclosure did not have criminal relevance because the tender process was private rather than public. The lawyer recommended that Luger obtain an independent expert opinion to clarify the legal aspects of the situation. Luger admitted he was unsure whether he should inform the board about the whistleblower’s findings. He expressed concern that political opponents might exploit the information and spread it in the media. The court later determined that Luger had acted reasonably in seeking legal advice and relied on that guidance. Two other lawyers prepared the expert reports, which examined the legal implications of the situation. They assessed whether the information should have been shared (by Luger) or retained (by Kerschbaum). During the trial, these lawyers submitted a written statement to the LIVA, which the judge read aloud. Under professional secrecy rules, they could not directly answer the court’s questions but instead provided their analysis in writing. The judge ruled that the expert reports were necessary and justified. She concluded that Luger's actions, while ethically questionable, did not meet the legal definition of fraud. The experts noted that had they known Luger was the whistleblower, they would have conducted a more thorough examination, which would have increased costs. Ultimately, the court found that Luger’s actions were cost-effective and legally defensible. The prosecution has three days to file an appeal. While Luger, who did not admit guilt, was surprised by the acquittal, observers were equally taken aback. Originally, the case had been dismissed as a diversion, but the higher court overturned that decision, citing serious concerns about the defendant’s character.
