ICE wants custody of illegal immigrant charged with trying to grab Fairfax County officer's gun

Federal immigration authorities are seeking custody of an undocumented immigrant who was recently charged with attempting to seize a police officer’s weapon during a domestic dispute in Fairfax County, Virginia. The individual, identified as Nehemia Noel Fuentes-Banegas, a 26-year-old Honduran national, was apprehended after a confrontation with law enforcement on Tuesday morning. According to local police, the incident occurred around 10 a.m. at a residence in the 7000 block of Sutter Lane in Annandale, where officers responded to reports of self-harm and threats against a family member. Fuentes-Banegas allegedly became violent with a pair of knives, prompting his wife to call for assistance. When officers arrived, the suspect fled the scene and sought refuge in a nearby wooded area. After a 15-minute search, he emerged from the underbrush and attempted to take hold of an officer’s firearm. Police Chief Kevin Davis described the encounter during a press conference, stating that Fuentes-Banegas grasped both the barrel and frame of the officer’s gun with his right hand. The officer fired three warning shots, which grazed the suspect, while another officer deployed a Taser to subdue him. Fuentes-Banegas was subsequently charged with attempted disarming of a law enforcement officer and is currently held without bail. Authorities noted that the suspect has a documented history of domestic violence, including prior arrests for suffocation, abduction, and assault of a family member. These charges were reportedly dismissed by the Fairfax County Commonwealth’s Attorney’s Office in May of this year. Immigration and Customs Enforcement (ICE) has formally requested that Fairfax County transfer custody of Fuentes-Banegas to prevent his release into the community. In a statement, a spokesperson for the Department of Homeland Security emphasized the gravity of the situation, referring to Fuentes-Banegas as a “criminal illegal alien” who “attacked a law enforcement officer and attempted to take the officer’s gun.” The statement further criticized Governor Abigail Spanberger and other “sanctuary politicians” for policies perceived to hinder immigration enforcement efforts. According to court documents, Fuentes-Banegas entered the United States illegally through Texas in 2022. His case highlights ongoing tensions between local law enforcement and federal immigration agencies regarding the handling of undocumented individuals with criminal histories. Separately, another case involving an undocumented immigrant has drawn attention due to its tragic consequences. Martin Martinez-Ballinas, a 38-year-old Mexican national, was arrested by ICE on July 22 after completing a federal prison sentence for illegally re-entering the United States. Martinez-Ballinas was previously linked to the 2017 hit-and-run crash that resulted in the death of U.S. Marine James Ray Walden III. At the time, Martinez-Ballinas was driving without a valid license or insurance when he collided with Walden’s motorcycle, killing him instantly. Martinez-Ballinas faced multiple deportations over the years, having been removed in 2020 and again in October 2022. However, he re-entered the country undetected, leading to his arrest in December 2023. His father, Martin Walden, has spoken publicly about the loss of his son, describing him as a highly skilled intelligence analyst with a promising career ahead. Walden expressed strong opposition to proposals to dismantle ICE, arguing that such measures would undermine efforts to enforce immigration laws and protect communities from potential dangers posed by undocumented individuals with criminal records. The cases of Fuentes-Banegas and Martinez-Ballinas reflect broader debates surrounding immigration policy, law enforcement responsibilities, and the role of federal agencies like ICE in addressing crimes committed by undocumented immigrants.
