First-time offenders can now be referred to the HSE when found with drugs for personal use

Ireland's Health Referral Scheme, a pilot program launched by the Department of Health, Department of Justice, HSE, and An Garda Síochána, allows first-time offenders found with small quantities of controlled drugs for personal use to be referred to health services instead of facing prosecution or a caution. The scheme, which became effective on 1 September, requires offenders to admit guilt and agree to participate in the program, during which they would meet with a SAOR practitioner for support and guidance. The initiative aims to promote early engagement with health services, reduce long-term harm from drug use, and focus law enforcement efforts on more serious offenses like drug trafficking. The government had planned the scheme since 2019 but faced criticism for not going far enough. Offenders who refuse the referral will still face legal consequences under the Misuse of Drugs Act.

HSE scheme offers alternative to prosecution over drugs

Ireland's Health Referral Scheme, introduced on September 1, 2026, allows Gardaí (police) to refer adults caught with small amounts of drugs to a health-based intervention instead of prosecuting them. This initiative replaces the previous practice of charging individuals with simple possession. The scheme enables referrals to rehabilitation programs but does not eliminate criminal prosecution. Garda Commissioner Justin Kelly emphasized the harm-reduction approach, while Minister Jennifer Murnane O'Connor highlighted the shift toward addressing drug use through health services rather than the criminal justice system. The program is limited to eligible first-time offenders and maintains that possession of controlled substances remains illegal.

Bias read (Center): The article presents the policy change as a balanced development, citing both law enforcement and health sector perspectives. It avoids overtly positive or negative language about the reform, focusing on the implementation and intent behind the scheme. While the policy aligns with progressive drug政策
