Judge Calama rejects the nullity of the case that Zapatero intended to ask for his defense out of time and summons to declare the directors of Plus Ultra

A Spanish court judge, José Luis Calama, has rejected an attempt by former Prime Minister José Luis Rodríguez Zapatero’s defense team to challenge the validity of the Plus Ultra case due to the submission being outside the legal deadline. The defense, led by Professor Víctor Moreno Catena, filed the objection on June 25, 2026, arguing that several fundamental rights were violated and requesting the exclusion of twelve resolutions. According to Article 241 of the Organic Law of the Judiciary, the 20-day period for filing such objections begins when the affected party has effective knowledge of the act violating their rights. The judge clarified that this knowledge requires actual access to the proceedings, not just subjective assessments or strategic convenience. He noted that the defense claimed they learned of the issue through access to a cloud platform and procedural developments, but the filing was still late. As a result, the objection was deemed inadmissible. Additionally, the judge has ordered the directors of Plus Ultra to appear for questioning.
