The Federal Communications Commission (FCC) has proposed a sweeping expansion of its drone import restrictions, targeting devices it had previously approved for sale in the United States. This includes drones and their components, such as cameras, manufactured abroad and sold domestically. The proposed rule applies specifically to foreign-produced uncrewed aircraft systems (UAS) and related critical components. The FCC has identified nine manufacturers by name, suggesting these entities may function as front companies for DJI, the Chinese firm that dominates the global consumer drone market with over 90% share. The agency has reportedly sent requests for information to these firms, with eight failing to respond. As a result, the FCC plans to impose fines of $25,000 per non-responsive entity. Under federal law, the FCC maintains a list of communications equipment or services considered a national security risk. Once listed, such items are prohibited from being sold, imported, or advertised within the U.S. The agency’s current rule allows it to deny authorization for transmitters associated with these devices. In December, the FCC implemented a broader ban on all drones and drone components made outside the country, citing concerns over reliance on foreign-made unmanned aerial systems threatening national security. However, the latest proposal marks a shift. While the previous ban allowed consumers to retain previously purchased drones and permitted retailers to continue selling them, the new directive aims to remove these devices from the market entirely. The FCC has granted itself the authority to enact this change through a revised rule adopted in October 2025. This rule mandates that regulators perform a “public interest analysis” for each item, emphasizing the risk posed by previously authorized equipment. The analysis gives significant weight to whether the equipment presents an “unacceptable risk” to U.S. national security or the safety of its citizens. If enacted, the retroactive ban could lead to the removal of thousands of drones and related components from retail platforms like Amazon. Industry experts suggest that companies may face substantial financial losses due to unsold inventory. FCC Chairman Brendan Carr has consistently advocated for stricter controls on DJI, urging its inclusion on the covered list since 2021. In 2017, a Department of Homeland Security intelligence bulletin raised alarms about DJI potentially transmitting sensitive data from U.S. critical infrastructure and law enforcement to the Chinese government. Despite these warnings, the government has yet to provide concrete evidence supporting the claim that foreign drones pose a tangible threat. DJI has responded to these allegations by asserting that an independent security audit of its products found no evidence of data transmission beyond U.S. borders, no backdoors, and no unauthorized remote access mechanisms. The company also noted the absence of unexplained radio frequency emissions. These findings contradict the FCC’s stance, highlighting a growing divide between regulatory action and industry assurances. As the FCC moves forward with its proposal, it will seek public input before finalizing the rule. The agency’s decision reflects ongoing tensions between national security concerns and the practical realities of a globally sourced supply chain. With the potential for widespread impact on both consumers and businesses, the outcome of this process will likely shape the future of drone technology in the United States.
